

Durable Power of Attorney
A Durable Power of Attorney gives someone else permission to act on a person's behalf even while that person is still alive. This is important to protect you and your family should you be unable to care for yourself. People that may suffer from dementia, senility, or incapacity in the future and who are no longer competent to make their own decisions, need to continue to make financial and medical decisions. Our Durable Power of Attorney protects you in this case. There are no court proceedings to go through if you have a Durable Power of Attorney.
What happens if you are incapacitated and have not signed our Durable Power of Attorney? You will probably have a conservatorship set up for you. Conservatorship is a long and expensive court procedure requiring someone to become your Conservator. In many cases, it is also unreasonable to expect there will be enough money and time to go through the court proceedings necessary to establish the conservatorship. Therefore, you absolutely do not want a conservatorship established for you.
